Terms of Use
The Privacy and Terms of Use pages both contain some sample text that must be reviewed and edited by your organization.  It's important to have these for legal reasons.  If you have a merchant account, the merchant account provider typically requires these pages to be here, as well as information on the organization's refund policy, shipping policy, physical mailing address, and phone number. These are part of PCI compliance, which you can read more about here.

 The Terms of Use set forth the terms and conditions that apply to your use of ashehouston.org, collectively referred to as the Web Site. Use of the Web Site indicates acceptance and agreement of all terms set forth herein. The right to use the Web Site is personal to you and is not transferable to any other person or entity.

 ASHE Houston Section may provide hyperlinks to third-party web sites as a convenience to users of the Web Site.  ASHE Houston Section does not control third-party web sites and is not responsible for the contents of any linked-to, third-party web site.  ASHE Houston Section will have no liability to any entity for the content or use of the content available through such hyperlink. Third-party websites accessed through web site are accessed at the user’s own risk.


Payments & Security
ASHE Houston Section reserves the right to refuse refund for any reason and without requirement for justification. Payments made are at the user’s own risk. Payment data will not be stored by ASHE Houston Section or its website in any way (digital, written, or otherwise). ASHE Houston Section will not be held liable for any loss or theft incurred by security failures on the website. A third-party will be responsible for managing and maintaining the security of the website and financial transactions that occur on it.


Lost or Un-Receieved Merchandise
ASHE Houston Section is not responsible for lost or unreceived merchandise, including but not limited to digital event tickets and physical merchandise. Inquiries about lost or unreceived merchandise can be reported to [email protected].


Sponsorship
ASHE Houston Section reserves the right to revoke sponsorship privileges for any reason. Sponsorship perks (including but not limited to recognition at events and representation on the website) are not guaranteed and may be changed at any time without requirement for justification or prior notice.


Collection of Personal Information
ASHE Houston Section reserves the right to require the user to provide personal information to maintain active membership and/or attend events. Required personal information may include but is not limited to full legal name, email address, phone number, mailing address, employer/educational institution, and dietary restrictions. Personal information may be shared with ASHE National. ASHE Houston Section will not be held responsible for the loss or theft of personal information, either via its own records or the records held by other parties (including ASHE National). The ASHE Houston Section Board of Directors and its committees reserve the right to access available personal information to carry out organizational functions.


Events, Cancellations, Substitutions & Program Changes
1.    Attendee cancellations. Unless a different policy is stated on the event registration page before purchase, cancellation requests received at [email protected] at least three business days before the event are eligible for a full refund. Requests received after that deadline and failure to attend are not eligible for a refund.
2.    Attendee substitutions. Registrations may be transferred to another attendee at no additional administrative charge by notifying to [email protected] before the event. Any applicable difference in registration rates, including member and nonmember rates, must be paid. Substitutions remain subject to event eligibility requirements.
3.    Event cancellation or postponement. If ASHE Houston Section cancels an event without rescheduling, registration payments, including fees collected by ASHE Houston Section, will be refunded. If an event is postponed, registrations will transfer to the rescheduled date. Registrants may instead request a refund within 14 calendar days after notice of the new date.
4.    Program changes. Speakers, panelists, topics, agendas, and schedules are subject to change. Individual speaker substitutions and routine program adjustments generally do not qualify for refunds. If ASHE Houston Section materially changes the event’s location or format, registrants will be notified and offered an opportunity to request a refund.
5.    Weather and other disruptions. ASHE Houston Section may cancel, postpone, or modify an event because of severe weather, safety concerns, venue unavailability, or other circumstances beyond its reasonable control. The cancellation, postponement, and program-change policies above will apply. ASHE Houston Section does not reimburse attendees’ travel, lodging, or other incidental expenses.
6.    Attendance and conduct. ASHE Houston Section may deny admission or remove attendees for disruptive behavior, harassment, safety concerns, or violation of event rules. Removal for these reasons does not qualify for a refund. If ASHE Houston Section denies admission for reasons unrelated to attendee misconduct, the registration payment will be refunded.
7.    Notices and event-specific policies. Event changes will be communicated using the email address provided at registration and posted on the event page when practicable. Any event-specific cancellation or substitution policy will be disclosed before purchase.


Use of Photographs
ASHE Houston Section reserves the right to take and distribute photographs at its events. Photographs may be used for advertising and promotion at any time. By agreeing to these terms, you grant ASHE Houston the express permission to take and distribute photographs of you and/or your guests at its events without the requirement of prior notice.


No Representations or Warranties; Limitations on Liability
 ASHE Houston Section DOES NOT MAKE ANY EXPRESS OR IMPLIED WARRANTIES, REPRESENTATIONS OR ENDORSEMENTS WHATSOEVER (INCLUDING, WITHOUT LIMITATION, THE IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE) WITH REGARD TO THE WEB SITE, THE MATERIALS, ANY PRODUCTS, INFORMATION OR SERVICE PROVIDED THROUGH THE WEB SITE, OR ANY SITES LISTED THEREIN, AND THE WEB SITE WILL NOT BE LIABLE FOR ANY COST OR DAMAGE ARISING EITHER DIRECTLY OR INDIRECTLY FROM ANY SUCH TRANSACTION. Governing Law and Jurisdiction
This Terms of Use constitutes a contract made under and shall be governed by and construed in accordance with the laws of Texas.
